MEMBER TERMS & CONDITIONS
These Terms & Conditions (the “Agreement”) govern the relationship between Raised Fitness (the “Facility”) and the undersigned member (“Member”).
By enrolling in a membership or purchasing access, the Member agrees to be bound by the following terms.
MEMBERSHIP OPTIONS
Raised Fitness offers:
(a) Contract Memberships (6-Month Term):
Adult Membership
Senior Membership
Student Membership
Family Membership
Adult Membership with Unlimited Classes
(b) Non-Contract Memberships (28 Days - Month-to-Month):
Adult Membership
Senior Membership
Student Membership
Family Membership
Adult Membership with Unlimited Classes
(c) Drop-In Access:
Gym access passes;
Class access passes.
Unused sessions or passes expire without credit, extension, or refund.
Membership benefits and access are specific to the plan selected at sign-up and may be amended by the Facility from time to time.
MEMBERSHIP TERM & RENEWAL
(a) Contract Memberships (6-Month Term)
Contract memberships have a minimum commitment period of six (6) months;
Membership fees are charged on a bi-weekly basis;
At the end of the initial term, the membership will expire unless renewed by the Member.
(b) Non-Contract Memberships (28-Day Memberships)
Non-contract memberships are offered in 28-day terms;
Membership fees are charged on a bi-weekly basis;
Memberships will expire at the end of each 28-day term unless renewed by the Member
BILLING & PAYMENT
Membership fees are billed on a recurring basis as agreed at sign-up;
Members must maintain valid payment information;
Missed payments may result in suspended access;
The Facility may apply administrative or late fees where applicable;
Pricing may be updated with reasonable notice.
The Member acknowledges that any failed or declined payments may result in:
Immediate suspension of access;
Reattempted billing;
Additional administrative or NSF fees where permitted.
The Facility reserves the right to refer outstanding balances to collections where necessary.
NO REFUND POLICY
All payments are final.
Refunds are not provided for:
Partial billing periods;
Unused membership time;
Failure to use the Facility;
Early termination of contract memberships.
CANCELLATION POLICY
(a) Non-Contract Memberships (28-Day Memberships)
Non-contract memberships are purchased on a 28-day basis and are billed bi-weekly.
These memberships cannot be cancelled mid-term and will expire at the end of the applicable billing cycle unless renewed.
(b) Contract Memberships (6-Month Term)
Memberships are committed for a minimum term of six (6) months.
Early cancellation is permitted subject to:
a minimum of 30 days’ written notice; and
payment of an early termination fee equal to two (2) months’ membership dues.
Cancellation shall take effect at the end of the applicable notice period, and all fees remain payable during that time.
(c) Notice Requirements
All cancellation requests must be submitted in writing using the Facility’s designated cancellation method..
Cancellation requests submitted verbally, via social media, or through informal communication channels will not be accepted.
(d) Special Termination Rights
Notwithstanding the above, memberships may be cancelled without penalty in the event of:
medical incapacity, supported by appropriate documentation; or
relocation beyond a reasonable distance from the Facility, such that continued use is impractical.
ACCESS & USE OF FACILITY
Access is provided in accordance with membership type;
Active Members may access the turf area within Raised Athletics, provided that no scheduled classes, training sessions, or reserved activities are in progress at that time;
Facility access may be temporarily restricted due to maintenance, cleaning, or events;
Access credentials must not be shared;
No guarantee of specific equipment or services at all time
Members are responsible for any damage to Facility property or equipment caused by misuse, negligence, or intentional acts and may be charged accordingly. The Facility reserves the right to pursue any additional remedies available at law or in equity in response to unauthorized access.
Members may not provide personal training or coaching services within the Facility without prior authorization.
The Facility may not be used for business, commercial, or promotional activities without prior written approval.
The Facility shall not be liable for interruptions due to events beyond its control, including but not limited to power outages, emergencies, or public health restrictions.
Use of the Facility is at the Member’s own risk and subject to the Waiver.
DROP-IN PASSES (GYM ACCESS & CLASS ACCESS)
Available as single-use or multi-use packages;
Non-refundable and non-transferable;
Subject to expiry;
Terms (including number of uses and validity) are defined at time of purchase;
Drop-ins do not grant membership privileges unless specified.
Unused sessions expire without credit or extension
Class packs and gym access punch passes expire six (6) months from the date of purchase, unless otherwise specified at the time of purchase.
Unused sessions expire without credit, extension, or refund.
MEMBER CONDUCT & RULES
Members must:
Use the Facility safely;
Act respectfully toward others;
Follow posted rules.
Prohibited:
Unauthorized access;
Equipment misuse;
Unsafe or disruptive behaviour.
Members are responsible for damage to equipment or property caused by misuse or negligence.
Unauthorized access or unsafe behavior is prohibited.
ZERO TOLERANCE – HARASSMENT & FILMING
Raised Fitness maintains a zero tolerance policy for harassment.
Harassment includes:
Unwanted comments or attention;
Threatening or offensive behavior;
Inappropriate physical contact;
Discriminatory or intimidating conduct.
Filming:
Recording or photographing others without consent is strictly prohibited.
Violations may result in:
Immediate termination without refund;
Further action where necessary.
CLASS ACCESS & SCHEDULING
(a) Unlimited Class Access & Booking Requirements
Members with unlimited class access may attend classes subject to:
Availability;
Advance booking through the Facility’s scheduling system.
(b) Advance Reservation Requirement
All classes must be reserved in advance where required. The Facility utilizes a booking system to manage class capacity and participation.
(c) Cancellation Policy (12-Hour Notice)
Members who reserve a class are expected to attend. If a Member is unable to attend a booked class, they must cancel their reservation no less than twelve (12) hours prior to the scheduled class start time.
(d) Late Cancellation & No-Show Fees
Failure to cancel a reservation within the required timeframe, or failure to attend a reserved class (“no-show”), may result in a charge or loss of class usage. Members on class-based memberships may be subject to a cancellation or no-show fee, while drop-in or multi-class pass holders shall forfeit the applicable class credit. Applicable fees or credit forfeitures shall be as communicated at the time of booking or as otherwise published by the Facility.
(e) Enforcement & Booking Privilege Management
The Facility reserves the right to:
Enforce cancellation and no-show fees;
Limit advance bookings;
Suspend or restrict class booking privileges for repeated late cancellations or no-shows;
Automatically suspend a Member’s ability to book classes for a period of one (1) week if the Member has one (1) or more no-shows within a seven (7) day period;
Modify booking policies, cancellation windows, or fees upon reasonable notice.
(f) Applicability to Pass Holders
Drop-in and multi-use class pass holders are also subject to the same booking, cancellation, and no-show policies.
(g) Schedule & Program Modifications
Class schedules, instructors, formats, and availability may be modified at any time at the discretion of the Facility.
FACILITY CHANGES
The Facility may modify:
Hours;
Equipment;
Layout;
Programs and services.
No refunds will be provided due to such changes.
The Facility does not guarantee the availability of specific equipment, services, instructors, or classes at all times.
MEMBERSHIP TERMINATION
The Facility may terminate membership for:
Breach of terms;
Unsafe or inappropriate conduct;
Rule violations.
No refund will be issued.
The Facility shall not be liable for any losses or damages arising from suspension or termination of membership in accordance with this Agreement.
PRIVACY & DATA
Member information is collected for:
Billing;
Communication;
Membership administration.
The Facility will take reasonable steps to protect Member information but does not guarantee absolute security of data
GOVERNING LAW
This Agreement is governed by the laws of Saskatchewan.
ACKNOWLEDGMENT
The Member confirms they:
Have read and understood this Agreement;
Agree to its terms;
Understand that they are waiving certain legal rights
